These Terms of Service ("Terms") govern your use of the website and services provided by Websirus ("we", "us", "our"), operated by Zachery Sager. By accessing our website at websirus.com or purchasing our services, you agree to be bound by these Terms.

1. Services

Websirus provides web development, design, and related digital services including but not limited to: custom website development, e-commerce solutions, SaaS application development, branding and identity design, SEO optimisation, and ongoing website care plans.

The specific scope, deliverables, and timeline for each project will be agreed upon prior to commencement and detailed in a project proposal or statement of work.

2. Pricing & Payment

All prices are displayed in British Pounds (GBP) and are exclusive of VAT unless otherwise stated. Payments are processed securely through our payment partner, Stripe, who processes payments securely on our behalf.

Project payments are typically structured as follows:

50% deposit upon project commencement
50% upon project completion and handover

Monthly care plans are billed on a recurring monthly basis. You may cancel your care plan at any time, effective at the end of your current billing period.

3. Project Process

Upon payment of the initial deposit, we will begin work according to the agreed timeline. Each project includes the number of revision rounds specified in your chosen package. Additional revisions beyond the included rounds may be quoted separately.

We require timely feedback and content from clients to maintain project timelines. Delays in providing materials or feedback may extend the delivery date.

4. Intellectual Property

Upon full payment, all custom code, designs, and assets created specifically for your project are transferred to you. We retain the right to showcase the completed work in our portfolio unless otherwise agreed in writing.

Third-party assets, fonts, stock images, and open-source libraries remain subject to their respective licences.

5. Client Responsibilities

You agree to:

Provide accurate and complete project requirements
Supply all necessary content, images, and brand assets in a timely manner
Review and provide feedback on deliverables within agreed timeframes
Ensure you have the right to use any content you provide to us

6. Limitation of Liability

Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project in question. We are not liable for any indirect, incidental, or consequential damages including lost profits or data.

We do not guarantee specific business outcomes, search engine rankings, or traffic levels resulting from our work.

7. Termination

Either party may terminate a project with 14 days' written notice. In the event of early termination, you will be invoiced for all work completed up to the termination date. The initial deposit is non-refundable once work has commenced.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project, unless disclosure is required by law.

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via email or a notice on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
